Surrogacy boon or Bane for society

 सेरोगेसी (विनियमन अधिनियम 2021) के अनुसार 35 से 45 वर्ष की महिला सेरोगेट मां बन सकती है वह महिला या तो विधवा या तलाकशुदा होनी चाहिए । वैवाहिक जोडे के पास कोई जैविक , दत्तक और सेरोगेट बच्चा नहीं होना चाहिए ।यह विधेयक व्यवसायिक सेरोगेसी पर पुर्ण प्रतिबंध लगाता है ।यदि कोई व्यवसायिक सेरोगेसी करेगा तो उस पर 10 साल की कैद और 10 लाख का जुर्माना अधिरोपित किया जायेगा ।

According to surrogacy (regulations act 2021) a woman can become a surrogate mother whose age between 35 to 45 years .that woman should be either a widow or a divorcee .that couple should not keep genetic ,adopted and surrogate child .this provision reins over commercial surrogacy throughly.if any one commits commercial surrogacy ,he will be punished with 10 years imprisonment or 10 lakh rupees as penalty .



जो जोड़ा सेरोगेसी का फायदा उठायेगा उस पुरुष की आयु 26-55  मध्य वर्ष होनी चाहिए और महिला की आयु 26 -50 वर्ष के मध्य होनी चाहिए । सेरोगेसी मे भावनात्मक जटिलताओं के कारण ऐसे रिश्ते  संवेदनाओं ‌के भंवर में फंसे सकते हैं ।किसी  औरत को सेरोगेट मां के लिए तैयार ‌करना‌ एक भागीरथी प्रयत्न ‌के समान है ।

Which couple takes benefit  of surrogacy ,that  male age should be 26 -55 years  and woman age should be 26-50  years. Such relations may entangled into whirlpool of senstiveness due to emotional complications in surrogacy .to persuade a woman to become a surrogate mother is a herculean task /uphill task 

2021 के एक्ट में केन्द्रीय सरकार ने कामर्शियल सरोगेसी पर प्रतिबंध लगा दिया है ।कोख के कारोबार पर प्रतिबंध लगा सकता है ।एक नया प्रावधान जोड़ा गया है जो महिला सेरोगेट बनेगी उसका कपल में से एक के साथ रिश्तेदारी होना जरुरी है ।इस मामले मे एक याचिका माननीय उच्चतम न्यायालय ‌में दायर की गयी ।इस याचिका में सेरोगेसी अधिनियम 2021 की धारा 4(3) c(2)की वैधता को चुनौती दी गयी थी।

Central government has tabooed over commercial surrogacy in act of 2021 . commercialization of wombs can be prohibited .a new provision has been added that those women becomes surrogate mother ,she should keep relationship with minimum at least one of couple .a writ has been filed in honourable supreme court in this matter .the validity of section  4(3)c(2) of surrogacy act 2021  had been challenged  in this writ .
