नवतेज सिंह जोहर बनाम भारतीय संध‌ ‌के मामले‌ में एक ऐतिहासिक फैसला दिया गया था ।इस फैसले  ने  समलैंगिकता की परिभाषा को एक नया आयाम दिया था ।कुछ  फैसले न्यायिक गरीमा और सैवंधानिक   सर्वोच्चता को अहमियत प्रदान ‌करते है ।कुछ फैसले  बुद्धिमान जजों की तार्किक टिप्पणी  के कारण विशिष्ट बन जाते हैं ।

An historical judgement had been announced in Navtej singh Johar versus union of India . This indomitable decision had given a new magnitude to definition of homosexuality .some decisions give significance to judicial glory and constitutional supremacy .some decisions become specific due to logical remarks of prudent judges .

इस महत्वपूर्ण फैसले ने धारा 377 को विध्वंस कर दिया है ।इस फैसले के अनुसार ‌राज सत्ता किसी व्यक्ति के नितांत निजी कार्यों में  दखल नहीं दे सकती है जबकि वे कार्य ईश्वर प्रदत्त शक्तियों और इच्छाओं से संचालित होते हैं ।सबसे बड़ी चर्चा का विषय यह है कि संवैधानिक  सर्वोच्चता की आड़ में प्राकृतिक   सर्वोच्चता की तिलांजलि नहीं दी जा सकती है । आदर्श समाज की स्थापना करने के लिए   व्यावाहरिक कठिनाइयों को नजर अंदाज नहीं किया जा सकता है ।

This significant decision has annihilated section 377 of IPC . according to this decision ruler regime cannot interfere absolutely personal work while  such work  is conducted by God given powers and desires .this is talking of town that natural supremacy cannot be sacrificed under the guise of constitutional supremacy.practical problems cannot be ignored to establish ideal society 


अभी तक LGBT समुदाय एक बंद‌ पिंजरे में फड़फड़ा रहा था मगर माननीय सर्वोच्च न्यायालय के इस फैसले ने इस तिरस्कृत समुदाय को एक नयी उड़ान दी है ।LGBT  समुदाय की  अपनी गरीमा बचाने के लिए युद्ध का बिगुल बजाया । फ़रवरी 2016 में  क्युरिटीव  याचिका पर सुनवाई कर ,इस ज्वलंत समस्या को सैंवधानिक पीठ के पास भेजा ।2017 में निजता के अधिकार‌ को ढाल‌ प्रदान की गयी और उसी परिपेक्ष्य में इस समलैंगिकता के बारे में एक क्रांतिकारी फैसला सुनाया।

LGBT community is flapping in a closed cage but the decision of honourable supreme court has given a new flight to this humiliated community.LGBT community had played on clarion for war.having heard curative petition in February 2016 ,this burning problem had been sent to constitutional bench .right to privacy had been shielded in 2017  and a revolutionary decision had been pronounced in this context .
