शंइतिहास इस बात का साक्ष्य देता है कि समलैंगिकता प्राचीन समय में प्रचलित हुआ करती थी ।रोमन और युनानी सभ्यता ने इस विचारधारा  को अपनी जीवनशैली का अभिन्न अंग बनाया ‌था । अप्राकृतिक कार्य मानकर , समलैंगिकता से नफ़रत की जाती है ।इस विचारधारा का तर्क विहिन तर्क के आधार पर विरोध किया जाता है ।

History give evidence of this thing that homosexuality used to prevail in ancient time .this goalpost had been made part and parcel of The Roman and the  yunani civilization.having assumed unnatural work , homosexuality is despised .this goalpost is protested on logicless logic .


समलैंगिक लोगों  ना तो  असामान्य कहा जा सकता है ना ही मानसिक रोगी कहा जा सकता है ।बराह मिहिर ने अपने ग्रंथ व्रहत जातक में वर्णित किया था कि समलैंगिकता पैदाइशी और  प्राकृतिक होती है । सामाजिक नैतिकता और बहुसंख्यकवाद किसी आजाद कौम की नियति तय नहीं कर सकती है । संविधान की कसौटी मानवीय गरीमा और समानता  के सिद्धान्त से संचालित होती है ।

Homosexual people is called neither abnormal nor mental patient.Barhar mihir had explained in his scripture Brahat Jatak that homosexuality is inborn and natural . social morality and majority ness cannot determine  destiny of liberal community.touch stone of constitution is conducted by human glory and equality.

न्यायालय ने 2014 में किन्नरों के , सशक्तिकरण हेतु उन्हें थर्ड जेंडर के रूप में मान्यता प्रदान की थी ।इस निर्णय के परिपेक्ष्य में  समलैंगिक संबंधों को अपराध की श्रेणी से बाहर करना था ।विधी आयोग ने 121‌वी रिपोर्ट में धारा 377 को हटाने की सिफारिश की थी । दुनिया में 26 देशों ने समलैंगिकता को कानूनी रुप दे दिया गया है । जबकि भारत में 10 करोड़ समलैंगिकों  कटघरे में खड़ा कर दिया था ।मगर यह महत्वपूर्ण फैसला दुरगामी और प्रगतिशील इतिहास रचेगा ।

Honour supreme court had given recognition to third gender for eunuch empowerment.homosexual people was to be excluded from category of offence .law commission had recommended to abrogated section 377 in its 121 th report.homosexulaity has been legalised in 26 countries.while 10 crore homosexual had been put into dock .but this significant decision will engrave remote and developing history.
