1. एक बैंक के ग्राहक ने अपने खाते से ओवरड्राफ्ट लिया था। इस भुगतान के लिए प्रतिवादी ने गारंटी दी थी। ओवरड्राफ्ट शून्य है और अधिनियम के तहत लागू नहीं है। ग्राहक ने भुगतान नहीं किया है। उस पर मुकदमा चलाया गया था। इस मामले में देयता की गारंटी के बारे में बताएं? (स्वान बनाम बैंक ऑफ स्कॉटलैंड)
