1.what do you mean by discharge of contract.describre all the situation in which a contract may be discharged 


Answer 

Discharge of a contract means termination of the contractual relation between the parties..when right and obligation of contract has been ended .this is known as discharges  from a contract.

A contract may be discharged in following conditions 

1.by performance 

2. By agreement or consent 

3.by lapse of time

4.by operation of law

5.by impossibility of performance 

6.by breach 

1.discharge by performance

If both parties perform their obligations then they will discharge from contract .this performance may be actual or attempted performance .


2.discharge by agreement 

If both parties will relinquish their rights and obligations by an agreement .this is known as discharge from a contract .the parties may agree to terminate the existence of contract by one of the following ways.

A.novation ---novation means new contract .when previous contract is ended by new contract .this is called Novation of contract . But Novation must be done by the consent of parties .in this condition there is no need to perform the old contract .


B.Alteration ---if both parties alteres in old contract .then there is no need to perform the old contract this altercation is valid when it is done by consent of parties


C.recission----when one party rescind the contract .in this condition there is no need to perform the contract.


3.discharge by lapse of time ---

Every contract must be performed in a limited or prescribed time .if limitation period is crossed then aggrieved Party cannot   enforce the contract .


4.insolvency --if any person is declared insolvent .then he is discharged from all libalities and debts .in this case there is no need to perform the contract .


5.death of promisor ---if promiser dies or if the contract depends on personal skills .in this condition there is no need to perform the contract.


6.discharged by impossibility of performance 

When any contract become impossible to perform .if subject matter is destroyed .to perform the contract is become impossible then there is no need to perform the contract 


7.discharge by breach of contract 

If any party cannot perform it's duty .then there is no need to perform if any party refuses to perform the contract .in that condition there is no need to perform the  contract
