What is declartory decrees ? Essential of a declaratory suit ?

Answer 

The declartory decrees is order which declares the right of the plaintiff.this declaration is done by court to declare the rights of plaintiff .declaratory decrees is given in section 35 of SRA when plaintiff is denied for his right .when he is entitled to that rights .he will take shelter of court to declare his rights this is known as declaratory suit .

There are four essential elements which are following 

1.the plaintiff was entitled to any legal character or any right to any property 

2.the defendant had denied or he was planning to deny the rights of plaintiff 


3.if plaintiff was entitled to that right the declaratory suit must determine the rights of plaintiff 


4.in this suit plaintiff cannot demand any relief except for his right .

State of M.P. VERSUS Khan Bhadur and company .

The court observed that relief of declaration will be given if four conditions are fulfilled by the plaintiff.


Maharaja Banaras versus Ramji khan 


It was declared that if the suit is filed and necessary party is absent then the court will dismiss the suit.

Father mehta was the headmaster of St.Xavier school .he played a significant role to shape personality of chagala.he emphasized the importance of character and morality.he used to dedicate towards students.chagala used to admire his dedication.he used to emphasize on ethical principles and social justice . Father's qualities left a sound impression on chagla .he was committed towards society ,justice and equality .
