What is decree
Section 2(2) cpc
डिक्री क्या है?
जब किसी दीवानी (Civil) मुकदमे में न्यायालय दोनों पक्षों की बात सुनकर उनके अधिकारों का अंतिम रूप से निर्णय कर देता है, तो उस निर्णय को डिक्री (Decree) कहते हैं।
आसान परिभाषा
"डिक्री वह औपचारिक निर्णय है जिसमें न्यायालय यह तय कर देता है कि किस पक्ष का क्या अधिकार है और दूसरे पक्ष को क्या करना होगा।"
Essential Elements of a Decree (Section 2(2), CPC)
A valid decree has 5 essential elements:
Adjudication (निर्णयन)
There must be a judicial decision by a competent court.
Example: The court decides who is the owner of a disputed property.
In a Suit (वाद में)
The adjudication must arise from a civil suit instituted by a plaint.
If there is no suit, there can generally be no decree.
Determination of Rights of the Parties (पक्षकारों के अधिकारों का निर्धारण)
The decision must determine the substantive rights of the parties regarding the matters in dispute.
Procedural orders alone do not amount to a decree.
Conclusive Determination (अंतिम एवं निर्णायक निर्णय)
The decision must conclusively determine the rights of the parties on the issue decided.
It may be preliminary, final, or partly preliminary and partly final.
Formal Expression (औपचारिक अभिव्यक्ति)
The decision must be formally expressed in the manner prescribed by law (Order XX CPC).
डिक्री (Decree) के आवश्यक तत्व (Essential Elements of Decree) – धारा 2(2), CPC
डिक्री बनने के लिए निम्न 5 आवश्यक तत्व होने चाहिए:
1. निर्णयन (Adjudication)
न्यायालय द्वारा किसी विवाद पर न्यायिक निर्णय दिया जाना चाहिए।
उदाहरण: न्यायालय यह तय करे कि भूमि का वास्तविक मालिक कौन है।
2. वाद में होना चाहिए (In a Suit)
निर्णय दीवानी वाद (Civil Suit) में होना चाहिए।
यदि वाद (Suit) ही नहीं है, तो सामान्यतः डिक्री नहीं होगी।
3. पक्षकारों के अधिकारों का निर्धारण (Determination of Rights of the Parties)
निर्णय से पक्षकारों के वास्तविक (Substantive) अधिकारों का निर्धारण होना चाहिए।
केवल प्रक्रिया (Procedure) से संबंधित आदेश डिक्री नहीं होते।
4. अंतिम एवं निर्णायक निर्णय (Conclusive Determination)
निर्णय विवादित अधिकारों का निश्चित और अंतिम रूप से निर्धारण करे।
यह प्रारंभिक (Preliminary), अंतिम (Final) या आंशिक प्रारंभिक एवं आंशिक अंतिम (Partly Preliminary and Partly Final) हो सकता है।
5. औपचारिक अभिव्यक्ति (Formal Expression)
न्यायालय के निर्णय को कानून के अनुसार लिखित एवं औपचारिक रूप में व्यक्त किया जाना चाहिए।
CPC (Code of Civil Procedure), 1908 – धारा 2(2) : डिक्री (Decree)
धारा 2(2) –what includes in decreee
1."The rejection of a plaint" (वादपत्र/प्लेंट का अस्वीकार किया जाना)
2."The determination of any question within Section 144"
Which things not included in order
Any adjudication from which an appeal lies as an appeal from an order
If the CPC provides that a decision is appealable as an order (and not as a decree), it is not a decree.
Example: An order granting or refusing a temporary injunction under Order XLIII Rule 1 CPC is an appealable order, not a decree.
Any order of dismissal for default
If a suit is dismissed because the plaintiff or parties fail to appear (e.g., under Order IX CPC), such dismissal is not a decree.
Example: The plaintiff does not appear on the hearing date, and the suit is dismissed for default. This is not a decree.
Easy way to remember (APO/RJS Exam)
Not included in a decree:

❌ Dismissal for default
Included in a decree:
✅ Rejection of a plaint
✅ Determination of a question under Section 144 CPC (restitution)
डिक्री में क्या शामिल नहीं है? (Section 2(2), CPC) – सरल हिन्दी में
धारा 2(2) CPC के अनुसार निम्नलिखित डिक्री में शामिल नहीं हैं:
ऐसा निर्णय जिससे आदेश (Order) के विरुद्ध अपील की जा सकती हो।
अर्थात यदि किसी निर्णय के विरुद्ध Order के रूप में अपील का प्रावधान है, तो वह डिक्री नहीं कहलाएगा।
उदाहरण: अस्थायी निषेधाज्ञा (Temporary Injunction) देने या मना करने का आदेश।
वाद (Suit) का डिफॉल्ट (Default) के कारण खारिज होना।
यदि वादी या पक्षकार न्यायालय में उपस्थित नहीं होता और इसी कारण वाद खारिज कर दिया जाता है, तो वह डिक्री नहीं है।
उदाहरण: वादी की अनुपस्थिति के कारण Order IX CPC के तहत वाद खारिज होना।
डिक्री में शामिल नहीं हैं:
❌ आदेश (Order) से अपील योग्य निर्णय।
❌ डिफॉल्ट (अनुपस्थिति) के कारण वाद की खारिजी।
लेकिन डिक्री में शामिल हैं:
✅ Plaint (वादपत्र) का अस्वीकार (Rejection of Plaint)।
✅ धारा 144 CPC (Restitution/प्रत्यास्थापन) के अंतर्गत निर्णय।
सरल उदाहरण
➡️ यह आदेश डिक्री (Decree) है।
➡️ यह भी डिक्री है।
डिक्री की मुख्य बातें
यह केवल दीवानी (Civil) मामलों में होती है।
यह न्यायालय द्वारा औपचारिक (Formal) रूप से दी जाती है।
इसमें पक्षों के अधिकार और दायित्व तय होते हैं।
डिक्री के आधार पर Execution (निष्पादन) कराकर निर्णय को लागू कराया जा सकता है।

डिक्री वह अंतिम औपचारिक निर्णय है, जिससे मुकदमे में पक्षकारों के अधिकार निश्चित हो जाते हैं और जिसे कानून के अनुसार लागू कराया जा सकता है।
प्रारम्भिक डिक्री (Preliminary Decree) और अंतिम डिक्री (Final Decree) में अंतर (Order 20 Rule 18 एवं Section 2(2) CPC)

सरल उदाहरण
1. Preliminary Decree (प्रारम्भिक डिक्री)
न्यायालय कहता है—
A का 1/3 हिस्सा
B का 1/3 हिस्सा
C का 1/3 हिस्सा
यह तो तय हो गया कि किसका कितना हिस्सा है, लेकिन किसे कौन-सा कमरा या खेत मिलेगा, यह अभी तय नहीं हुआ।
➡️ यह Preliminary Decree है।
2. Final Decree (अंतिम डिक्री)
बाद में आयुक्त (Commissioner) की रिपोर्ट आने के बाद न्यायालय कहता है—
A को पूर्वी भाग मिलेगा।
B को पश्चिमी भाग मिलेगा।
C को दक्षिणी भाग मिलेगा।
अब संपत्ति का वास्तविक बंटवारा हो गया।
➡️ यह Final Decree है।
Difference between preliminary and final decree
Preliminary Decree = अधिकार (Rights) तय करती है।
Final Decree = अधिकार लागू (Implementation) करती है और मुकदमा समाप्त करती है।
महत्वपूर्ण Landmark Judgments
1. Phoolchand v. Gopal Lal
सिद्धांत:
एक ही मुकदमे में आवश्यकता होने पर एक से अधिक Preliminary Decree पारित की जा सकती हैं।
विशेष रूप से Partition Suit में परिस्थितियों के बदलने पर नई Preliminary Decree संभव है।
2. Shub Karan Bubna v. Sita Saran Bubna
सिद्धांत:
Partition Suit में Preliminary Decree के बाद न्यायालय को बिना अनावश्यक विलंब Final Decree Proceedings पूरी करनी चाहिए।
अंतिम डिक्री के बाद ही संपत्ति का वास्तविक विभाजन प्रभावी होता है।
Important points about preliminary and final decree
Preliminary Decree अधिकार निर्धारित करती है, जबकि Final Decree मुकदमे का अंतिम निपटारा करती है।
Preliminary Decree के बाद मुकदमा लंबित रहता है।
Final Decree के बाद केवल Execution शेष रहती है।
Partition Suit में एक से अधिक Preliminary Decree पारित की जा सकती है (Phoolchand v. Gopal Lal).
Final Decree वास्तविक विभाजन (Actual Partition) को लागू करती है (Shub Karan Bubna v. Sita Saran Bubna).
