Practical questions over decree

 


Problem:
A ने B के विरुद्ध partition suit दायर किया। Court ने यह घोषित कर दिया कि A और B दोनों संपत्ति में ½–½ हिस्से के अधिकारी हैं, लेकिन अभी वास्तविक विभाजन नहीं किया। क्या यह decree है? कौन-सी decree?

उत्तर:
हाँ। यह Preliminary Decree है।
Court ने पक्षकारों के अधिकार निर्धारित कर दिए हैं, लेकिन suit का पूर्ण निपटारा अभी बाकी है।

ध्यान रखें:
👉 Rights determined = Preliminary Decree
👉 Actual partition बाद में = Final Decree


2. Final Decree का Practical Question

Problem:
Partition suit में Court ने पहले A और B के हिस्से ½–½ निर्धारित किए। बाद में commissioner ने संपत्ति का वास्तविक विभाजन कर दिया और Court ने प्रत्येक को उसका निश्चित हिस्सा दे दिया। यह कौन-सी decree है?

उत्तर:
यह Final Decree है, क्योंकि अब पक्षकारों के अधिकारों का वास्तविक और अंतिम निर्धारण हो गया है।


3. Rejection of Plaint

Problem:
A ने एक suit दायर किया। Court को लगा कि plaint में cause of action ही नहीं है। Court ने plaint reject कर दी। क्या यह decree है?

उत्तर:
हाँ। Rejection of plaint को Section 2(2) CPC के तहत decree माना जाता है।

इसलिए इसके विरुद्ध सामान्यतः appeal की जा सकती है।


4. Dismissal for Default

Problem:
A ने suit दायर किया लेकिन hearing की तारीख पर वह उपस्थित नहीं हुआ। Court ने suit को default में dismiss कर दिया। क्या यह decree है?

उत्तर:
नहीं। सामान्यतः dismissal for default decree नहीं है।

यह महत्वपूर्ण distinction है:

Rejection of plaint → Decree
Dismissal for default → Decree नहीं


5. Dismissal of Appeal

Problem:
A ने decree के विरुद्ध appeal की। Appellate Court ने appeal को केवल limitation के कारण dismiss कर दिया। क्या appellate order decree है?

उत्तर:
यह facts और dismissal के तरीके पर निर्भर करेगा। यदि appeal का निर्णय merits पर हुआ है, तो appellate decree की स्थिति बन सकती है; केवल procedural dismissal को सीधे decree नहीं माना जाना चाहिए।


6. Adjudication Not on Merits

Problem:
एक Court ने केवल procedural ground पर proceeding समाप्त कर दी। उसमें किसी पक्ष के substantive rights का निर्धारण नहीं हुआ। क्या प्रत्येक ऐसा order decree होगा?

उत्तर:
नहीं।

Section 2(2) CPC का मूल तत्व है—

Adjudication conclusively determining the rights of the parties

अर्थात केवल हर judicial order decree नहीं होता।


7. Mesne Profits का Practical Question

Problem:
A ने B के विरुद्ध property का possession माँगा और साथ में उस अवधि का mesne profit भी माँगा, जब B गलत तरीके से property पर कब्जा करके बैठा था। Court ने possession के साथ mesne profits का अधिकार निर्धारित किया, लेकिन exact amount बाद में inquiry द्वारा तय होना था। क्या decree हो सकती है?

उत्तर:
हाँ। Court पहले right/liability determine कर सकती है और amount बाद की inquiry में निर्धारित हो सकता है। यह CPC में decree की संरचना का महत्वपूर्ण practical उदाहरण है।


8. Compromise का Practical Question

Problem:
A और B के बीच property dispute था। दोनों ने Court के सामने compromise कर लिया। Court ने compromise को record करके उसके अनुसार decree पारित कर दी। क्या यह decree है?

उत्तर:
हाँ। यह compromise decree है।

Relevant provision: Order XXIII Rule 3 CPC.


9. Foreign Judgment वाला Practical Question

Problem:
एक भारतीय नागरिक के विरुद्ध England की competent court ने judgment दिया। भारत में उस judgment को लागू कराने का प्रश्न उठता है। क्या England की court CPC के अर्थ में foreign court होगी?

उत्तर:
हाँ। Section 2(5) CPC के अनुसार Foreign Court का अर्थ है ऐसी Court जो भारत के बाहर स्थित है और जिसे Central Government द्वारा स्थापित या जारी नहीं रखा गया है।

इसलिए England की सामान्य competent court Foreign Court होगी।


10. सबसे महत्वपूर्ण RJS-style Problem

Problem:
एक Court ने A और B के बीच property पर A के ownership right को conclusively determine कर दिया, लेकिन possession देने का प्रश्न बाद के चरण के लिए छोड़ दिया। B का कहना है कि “यह decree नहीं है क्योंकि possession अभी नहीं मिला।” क्या B सही है?

उत्तर:
नहीं। केवल इसलिए कि कुछ consequential relief बाद में दिया जाना है, adjudication decree होना बंद नहीं हो जाती। यदि Court ने पक्षकारों के rights को conclusively determine कर दिया है, तो Section 2(2) की decree की definition पूरी हो सकती है।

Practical Example of Decree — CPC Section 2(2)

मान लीजिए A ने B को ₹5 लाख उधार दिए। B ने पैसे वापस नहीं किए। A ने B के विरुद्ध ₹5 लाख की recovery का civil suit दायर किया।

Court ने evidence देखने के बाद फैसला दिया:

“B, A को ₹5,00,000 तथा निर्धारित ब्याज का भुगतान करे।”

अब इसे समझिए:

  1. A = Plaintiff

  2. B = Defendant

  3. Court ने दोनों पक्षों को सुनकर adjudication किया।

  4. Court ने A के अधिकार को conclusively determine किया।

  5. Court ने B को ₹5 लाख देने का निर्देश दिया।

  6. इस निर्णय को formal decree के रूप में तैयार किया जाएगा।

👉 इसलिए यह Decree है।

आसान भाषा में

Suit → Evidence → Court का निर्णय → Rights का अंतिम निर्धारण → Decree

Example:

A ने B से ₹5 लाख की recovery का suit किया। Court ने माना कि B वास्तव में ₹5 लाख A को देने के लिए liable है और decree पारित कर दी।

अब A Decree-holder और B Judgment-debtor कहलाएंगे।

“जब किसी civil proceeding में Court द्वारा पक्षकारों के अधिकारों का निर्णायक (conclusive) निर्धारण किया जाता है और उस adjudication को औपचारिक रूप दिया जाता है, तो वह decree कहलाती है।”

Section 2(2), CPC — यही इसका मुख्य आधार है।

Decree पर Practical Problem — RJS Pattern

Problem 1: Money Recovery

तथ्य:
A ने B को ₹2,00,000 उधार दिए। B ने पैसे वापस नहीं किए। A ने B के विरुद्ध recovery suit दायर किया। सुनवाई के बाद Court ने पाया कि B वास्तव में ₹2,00,000 का देनदार है और आदेश दिया कि B, A को ₹2,00,000 तथा ब्याज का भुगतान करे।

प्रश्न:
क्या Court का यह आदेश decree है? यदि हाँ, तो क्यों?

उत्तर:
हाँ, यह decree है।

कारण:

  • Court ने adjudication किया।

  • A और B के rights/liability निर्धारित किए।

  • निर्धारण conclusive है।

  • इसका formal expression decree के रूप में होगा।

Result:
A = Decree-holder
B = Judgment-debtor


Problem 2: क्या यह Decree है?

तथ्य:
A ने B के विरुद्ध ₹5 लाख की recovery का suit किया। Court ने कहा—

“B, A को ₹5 लाख देने के लिए liable है।”

लेकिन Court ने अभी यह तय नहीं किया कि payment किस तरीके और कब किया जाएगा।

प्रश्न:
क्या यह decree हो सकती है?

उत्तर:
हाँ, यदि Court ने parties के rights को conclusively determine कर दिया है, तो केवल execution/payment की प्रक्रिया बाद में होने के कारण adjudication decree नहीं बनना बंद नहीं होती।


Problem 3: Rejection of Plaint

तथ्य:
A ने ऐसा suit दायर किया जो कानून द्वारा barred था। Court ने Order VII Rule 11 के तहत plaint reject कर दी।

प्रश्न:
क्या plaint की rejection decree है?

उत्तर:
हाँ।

Section 2(2) CPC expressly rejection of plaint को decree की definition में शामिल करता है।


Problem 4: Dismissal for Default

तथ्य:
A ने B के विरुद्ध suit दायर किया। सुनवाई की तारीख पर A उपस्थित नहीं हुआ और Court ने suit को default के कारण dismiss कर दिया।

प्रश्न:
क्या यह decree है?

उत्तर:
नहीं। सामान्यतः dismissal for default को decree नहीं माना जाता।

Dismissal for Default → Decree नहीं ❌


Problem 5: Preliminary Decree

तथ्य:
A और B jointly एक मकान के मालिक हैं। A ने partition suit दायर किया। Court ने तय किया कि A का हिस्सा ½ और B का हिस्सा ½ है, लेकिन अभी मकान का वास्तविक विभाजन नहीं किया।

प्रश्न:
यह कौन-सी decree है?

उत्तर:
यह Preliminary Decree है, क्योंकि Court ने parties के rights निर्धारित कर दिए हैं, लेकिन suit को पूरी तरह dispose करने के लिए आगे की कार्यवाही बाकी है।


Problem 6: Preliminary से Final Decree

तथ्य:
ऊपर के मामले में बाद में Court ने property का वास्तविक विभाजन कर दिया और A को निश्चित हिस्सा तथा B को निश्चित हिस्सा दे दिया।

प्रश्न:
अब कौन-सी decree होगी?

उत्तर:
यह Final Decree होगी।

सबसे महत्वपूर्ण Formula

Rights निर्धारित हुए, लेकिन आगे inquiry/proceeding बाकी → Preliminary Decree

Rights + पूरी तरह final determination → Final Decree
