हिंदी: A, B के विरुद्ध ₹2,00,000 की वसूली के लिए सिविल वाद दायर करता है, लेकिन वादपत्र के साथ शपथपत्र प्रस्तुत नहीं करता। क्या धारा 26 CPC के अंतर्गत वाद उचित रूप से संस्थित किया गया है?

English: A, aged 16 years, files a suit against B for recovery of money in his own name without being represented by a next friend. Is the suit maintainable?

हिंदी: 16 वर्ष का A, B के विरुद्ध धन की वसूली के लिए अपने नाम से वाद दायर करता है, लेकिन उसके साथ कोई अगला मित्र (Next Friend) नहीं है। क्या वाद पोषणीय है?


English: A files a suit against B for recovery of ₹50,000. The court admits the plaint but does not issue summons to B. Can the suit proceed effectively against B without giving him notice?

हिंदी: A, B के विरुद्ध ₹50,000 की वसूली के लिए वाद दायर करता है। न्यायालय वादपत्र स्वीकार कर लेता है, लेकिन B को समन जारी नहीं करता। क्या B को सूचना दिए बिना उसके विरुद्ध वाद की कार्यवाही प्रभावी रूप से आगे बढ़ सकती है?

English: A files a suit against B, and the court issues summons requiring B to appear on a particular date. However, the summons is not served on B before that date. What should the court consider doing?

हिंदी: A, B के विरुद्ध वाद दायर करता है। न्यायालय B को एक निश्चित तारीख पर उपस्थित होने के लिए समन जारी करता है, लेकिन उस तारीख से पहले समन की तामील B पर नहीं हो पाती। न्यायालय को क्या करना चाहिए?

 

Question 5: Summons to Defendant Residing Outside Jurisdiction / अधिकारिता के बाहर रहने वाले प्रतिवादी को समन

English: A files a suit against B in Jaipur, but B resides in Delhi. The Jaipur court issues summons to B. Is it possible to serve summons on B even though he resides outside the territorial jurisdiction of the court?

हिंदी: A, जयपुर में B के विरुद्ध वाद दायर करता है, जबकि B दिल्ली में रहता है। जयपुर का न्यायालय B को समन जारी करता है। क्या न्यायालय की क्षेत्रीय अधिकारिता से बाहर रहने वाले B पर समन की तामील की जा सकती है?
