    धारा 16 से 20 धारा 16 अनुचित प्रभाव परिभाषित ----- 1.अनुबंध को अनुचित प्रभाव से प्रेरित कहा जाता है  जहां पक्षों के बीच विद्यमान संबंध इस प्रकार के हों कि  एक पक्ष दूसरे पक्ष की इच्छा पर हावी होने की स्थिति में है  और उस स्थिति का उपयोग दूसरे पर अनुचित लाभ प्राप्त करने के लिए करता है  2.विशेष रूप से तथा पूर्वगामी सिद्धांत की व्यापकता पर प्रतिकूल प्रभाव डाले बिना  एक व्यक्ति को दूसरे की इच्छा पर हावी होने की स्थिति में माना जाता है  क.जहां वह दूसरे पर वास्तविक या स्पष्ट अधिकार रखता है या जहां वह दूसरे के साथ प्रत्ययी संबंध में खड़ा है या  ख. जहां वह किसी ऐसे व्यक्ति के साथ अनुबंध करता है जिसकी मानसिक क्षमता आयु, बीमारी या मानसिक या शारीरिक कष्ट के कारण अस्थायी या स्थायी रूप से प्रभावित हो गई हो। 3.जहां कोई व्यक्ति दूसरे की इच्छा पर हावी होने की स्थिति में हो  उसके साथ एक अनुबंध में प्रवेश करता है  और यह लेन-देन प्रथम दृष्टया या प्रस्तुत साक्ष्यों के आधार पर अनैच्छिक प्रतीत होता है यह साबित करने का भार कि ऐसा अनुबंध अनुचित प्रभाव ...
