    अध्याय दो अनुबंध, शून्यकरणीय अनुबंध और शून्य समझौते  धारा 10. अनुबंध क्या समझौते हैं----  सभी समझौते अनुबंध हैं  यदि वे पक्षों की स्वतंत्र सहमति से बनाये गये हों  अनुबंध करने में सक्षम  वैध प्रतिफल के लिए तथा वैध उद्देश्य से  और इसके द्वारा स्पष्ट रूप से शून्य घोषित नहीं किया जाता है  इसमें निहित कोई भी बात भारत में लागू किसी भी कानून पर प्रभाव नहीं डालेगी  और इसके द्वारा स्पष्ट रूप से निरस्त नहीं किया गया  जिसके द्वारा किसी भी अनुबंध को लिखित रूप में करना आवश्यक है  या गवाह की उपस्थिति में या दस्तावेजों के पंजीकरण से संबंधित किसी कानून के तहत। ************ यदि कोई नाबालिग किसी अनुबंध में प्रवेश करता है तो यह शून्य या शून्यकरणीय होगा। इस भेदभाव का निर्णय 1984 में किया गया था।  Mohari Bivi versus Dharamdas ghosh  इस मामले के निर्णय के बाद यह निर्णय लिया गया है कि नाबालिग के साथ किया गया अनुबंध पूर्णतः अमान्य है।  इस मामले के तथ्य ---- वादी नाबालिग था, वह अपना मकान गिरवी रखकर 20,000/- रुपये का ऋण लेना चाहता था।...

    Section 25  Agreement without consideration void  Unless it is in writing  and registered or is a promise to compensate for something done or is a promise to pay debt barred by limitation law ------an agreement made without consideration is void ,unless ----- 1.it is expressed in writing and registered under the law for time being in force for the registration of documents and is made on account of natural love and affection between parties standing in a near relation to each other or unless  2.it is a promise to compensate wholy or in part a person who has already voluntarily done something for the promisor or something which the promisor was legally compellable to do or unless 3.it is a promise made in writing and signed by the person to be charged therewith or by his agent generally or specially authorized in that behalf to pay wholly or in part a debt of which the creditor might have enforced payment but for the law for the limitation of suits ...

    धारा 6 से 9 अनुबंध अधिनियम  धारा 6. निरस्तीकरण कैसे किया जाता है ------एक प्रस्ताव निरस्त किया जाता है  1.प्रस्तावक द्वारा दूसरे पक्ष को निरस्तीकरण की सूचना प्रेषित करने से  2.ऐसे प्रस्ताव में स्वीकृति के लिए निर्धारित समय बीत जाने पर  अथवा यदि कोई समय निर्धारित नहीं है  स्वीकृति की सूचना दिए बिना उचित समय बीत जाने पर  स्पष्टीकरण ----विभिन्न लेन-देन के लिए उचित समय अलग-अलग हो सकता है। सोने और चांदी के अनुबंध में बहुत कम समय की आवश्यकता होती है। लेकिन भूमि के अनुबंध में यह संभव है कि इसमें लंबा समय लगे  3.स्वीकृतिकर्ता द्वारा स्वीकृति से पहले की शर्त को पूरा करने में विफलता या उदाहरण - नमक की एक झील पट्टे पर दी जानी है। लेकिन स्वीकर्ता को कुछ धनराशि अग्रिम जमा करानी होगी। स्वीकर्ता ने तीन साल तक ऐसा नहीं किया। आवंटन रद्द कर दिया गया क्योंकि स्वीकर्ता द्वारा शर्तें पूरी नहीं की गई थीं।  4. प्रस्तावक की मृत्यु या पागलपन से, यदि उसकी मृत्यु या पागलपन का तथ्य स्वीकृति से पहले स्वीकारकर्ता को ज्ञात हो जाए।  एन----एलसीडी  ********...
