To make a valid contract the party should be competent.it means according section 11 both parties should be major ,sound mind and not disqualified by law .it any body enters into  any agreement .that agreement is void ab intio .any one cannot enter a not a contact with a prisoner and an alien enemy . similarly any person who is not a sound mind at the time of contact .he cannot enter into a contact when he is unsound mind .if anyone enters into a contact then that agreement is void ab intio .we can cite an example of mohari bibi versus Dharamdas ghosh .in this case it was decided that agreement with a minor is void ab initio.
