 Exception of the rule of privity of contract 


1.beneficiary in case of trust

A beneficiary is not party to a contract but he can enforce the contract for his own benefit.

Case law 

x transferred certain property to Y for benefit of Z .here Z can enforce the contract although he is not party of contract 

2.in the case of partition or other family arrangements 

When the case related with partion or some family arrangements.in such case the third party can file a suit for his benefit .

Shuppu anmal versus subramanian 

In partition deed two brothers agreed to pay 300/ per month in equal shares .the brothers refused to pay the amount .the mother can file a suit to get maintenance.

3.a principal can file a suit in any contract .which had been made by his agent . although he is not party of contract a principal can file a suit .


3.agreement creating a charge on immovable property 

Khawaja mohammed v/s hussaini begum 

The father of bride groom enters into an agreement with father of bride H.he agrees to pay 1500/ permonth to H.he created charge on property for this purpose.this money had not been given .in this case bride H can file a suit to get money 


4.where a promise is made in marriage settlement 

Where an agreement is made in connection with marriage and a provision is made for the benefit of a person .then third person can file a suit for his benefit 


5.where a contract is transferred in favour of another person 

When a contract is transferred from one person to another person.then transferee can enforce the contract although he is not party of contract 

Example -----A draws a bill on B and B accepted .A endorse that bill in favour of C .

On due date C can recover the bill amount from B . although he is stranger to the contract 


7.acknoledgement of payment 

A party makes payment to B for the third party C .here C can file a suit  to get money although he is not party of the contract
